Por uma regulação e governança transnacional da educação superior: um bem comum global

Abstract

This thesis is part of the line of research State, Transnationality and Sustainability, and of the area of research concentration Constitutionalism, Transnationality and Production of Law. Its theme is a reflection on the possibility and the general premises for thinking about Transnational Regulation and Governance of Higher Education, defining Higher Education and Translational Education, proposing the analysis of Higher Education in its concept as a Global Common Good. The scientific objective of this thesis is to determine the general premises used to create the Transnational Regulation and Governance of Transnational Higher Education, based on the concept of Higher Education as a Global Common Good, without ignoring the characterization of Higher Education as a Global Public Good, a Fundamental Right, a Human Right, and Transnational Law. As a result, it was found that Higher Education must be conceived and treated as a Global Common Good, and that to receive guarantees, it needs a transnational regulatory framework to fill the regulatory gap in the transnational space, which is currently characterized by just a few fragmented, disorganized, uncoordinated, regulations that are liable to being governed by private interests, without commitment to the common good. This work also addresses Transnational Governance of Education and of a Transnational Regime for Education, giving an overview of this Governance, which in order to operate, requires the construction of a society in which there is mutual solidarity
